Because Leisure World operates through Mutual corporations and the Golden Rain Foundation (GRF), buyers are stepping into a heavily regulated community. By law, the seller must provide the buyer with a complete set of the community's governing documents so they can review the rules, financial health, and restrictions before finalizing the purchase.
What the Buyer Receives
The Governing Rules
This includes the Covenants, Conditions, and Restrictions (CC&Rs), the Mutual's specific bylaws, and the GRF's overarching community rules. It covers everything from pet restrictions to approved contractor hours.
Financial Disclosures
The buyer receives the Mutual's operating budget, reserve studies (which show if the Mutual has enough money saved for future roof or plumbing repairs), and recent financial statements.
Meeting Minutes
Recent Mutual board meeting minutes are provided so the buyer is aware of any ongoing community issues, pending assessments, or upcoming major projects.
Compiling this massive, legally compliant, and up-to-date packet takes administrative work. The management company charges a standard fee of $477 to assemble and release these documents.
How and When to Pay
During the escrow process, Escrow will call you directly to collect a credit card to pay for this charge. This must be paid between contract and closing so the documents can be ordered for the buyer. While it is an out-of-pocket expense required before closing, we have already accounted for this expense in the overall closing costs estimates we provided to you.
